By accessing or using the EightSix platforms and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and EightSix GmbH ("EightSix", "we", "us", or "our").

EightSix provides music intelligence platforms that help brands discover, evaluate, and license music. Our services include brand music DNA analysis, artist matching, licensing facilitation, and related analytics tools. The specific features available to you depend on your subscription plan.

To use our Service, you must:

• Be at least 18 years old or have legal capacity to enter into contracts
• Provide accurate, complete, and current registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

Access to certain features requires a paid subscription. By subscribing, you agree to:

• Pay all applicable fees according to your chosen plan
• Provide valid payment information
• Automatic renewal unless cancelled before the renewal date
• No refunds for partial subscription periods, except where required by law

The Service, including its original content, features, and functionality, is owned by EightSix and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

EightSix facilitates connections between brands and music rights holders. We do not guarantee the availability of any specific music or licensing terms. All music licenses are separate agreements between you and the respective rights holders. EightSix is not a party to these license agreements and bears no responsibility for disputes arising from them.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its servers
• Transmit viruses, malware, or other malicious code
• Scrape, data-mine, or extract data from the Service without permission
• Impersonate any person or entity
• Violate the intellectual property rights of others

To the maximum extent permitted by law, EightSix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
